European Charter for Regional or Minority Languages - Collected texts

The European Charter for Regional or Minority Languages is one of the
key conventions of the Council of Europe. Its aim is to protect and
promote the linguistic diversity in each of the states parties. It is a
unique legal instrument, the only one in the world specifically devoted
to the protection and promotion of minority languages. The charter being
a rather complex instrument, this document aims at providing a
user-friendly compilation of basic texts on how the charter operates and
how its monitoring mechanism works. This compilation is therefore
addressed not only to government experts and central, local and regional
authorities of the states parties to the charter, but also to
representatives of regional or minority language speakers,
non-governmental organisations, students, researchers and anyone else
interested in the protection and promotion of minority languages.

Intercultural cities - Towards a model for intercultural integration

Intercultural cities introduces a new model of local governance and
policy in the age of diversity: the model of intercultural integration.
This model has been built on the basis of experience in real-life cities
and with their active participation. City-to-city mentoring and learning
have played a key role in this process. This volume explains what
intercultural integration means in practice: how it affects policies,
governance and citizenship, public discourse, media relations, public
services and the urban environment. It reviews the processes that
facilitate the development of intercultural strategies and presents a
wide range of examples, including the intercultural profiles of 11
cities across Europe. Intercultural integration adds another dimension
to the management of culturally diverse populations, compared to
previous models, in particular multiculturalism. In addition to
non-discrimination, equal opportunities and cultural rights,
interculturalism focuses on building trust and cohesion by encouraging
interaction and mixing between cultural groups in the public realm and
encouraging a positive discourse and attitude to diversity within the
community. It also focuses on improving the efficiency of public
services by making them more culturally sensitive and adapted to the
needs of diverse users, and on the need for specific services such as
those dealing with intercultural mediation and conflict prevention.

The question of accommodations that institutions and citizens must make
to ensure social cohesion in pluralist societies is of concern to the
Council of Europe. How will we live and interact together in diversity?
It is becoming increasingly important to provide responses and devise
innovative frameworks (in the legal sphere, in national education and
training in competences and in institutional practice) which can help
build a shared vision while at the same time respecting each individual.
By comparing European and Canadian responses, among others, the articles
featured in this volume explore this complex issue. They contribute to a
major social debate and outline a vision of the future that allows us to
set aside mutual suspicion and develop institutional arrangements and
forms of social interaction capable of making diversity a factor for
progress, well-being and social justice. They also remind us that

Biomedicine and human rights - The Oviedo Convention and its additional
protocols (23/02/2010)
The Convention on Human Rights and Biomedicine, also referred to as the
"Oviedo Convention", celebrated the 10th anniversary of its entry into
force in 2009. This legally binding instrument aims to protect the
integrity, dignity and identity of all human beings and guarantees
everyone, without discrimination, the respect for their rights and
fundamental freedoms with regard to the application of biology and
medicine. It shares with the European Convention on Human Rights the
same underlying approach and many ethical principles, and provides a
general framework for the protection of fundamental rights and freedoms
in the field of biomedicine. The Oviedo Convention also addresses new
challenges in biomedicine that are brought about by technological and
scientific developments, making it a reference text for patient rights
at the European level. The principles laid down in the Oviedo Convention
were further developed and complemented in additional protocols in
specific fields: prohibition of cloning of human beings, transplantation
of organs and tissues of human origin, and biomedical research and
genetic testing for health purposes. The texts presented in this
publication form a unique legally binding set of instruments at the
international level.

The cancellation of election results (Science and technique of democracy

Electoral law, like all other fields of law, is effective only if it
provides for sanctions. The cancellation of elections results, the most
serious of sanctions, is in general linked to the most serious of
irregularities, especially when its effects are felt beyond a small
constituency. However, small technical inaccuracies may affect election
results if the difference in votes is minimal, as recent examples such
as the notorious 2000 United States presidential elections have shown.
This book aims to determine when electoral disputes should lead to such
a consequence, based on the practice of national, constitutional and
supreme courts throughout Europe, as well as on the practice of the
European Court of Human Rights. This publication contains the reports
presented at the Seminar on Cancellation of Election Results, organised
by the Venice Commission in co-operation with the Constitutional Court
of Malta and the Maltese Ministry of Justice and Home Affairs, on 14 and
15 November 2008.
