Effective Court Decision in the Tiszavasvari Segregated Graduation
Case Budapest / HUNGARY ( Roma Press Center / Budapest ) April the
28th, 1999 April the 22nd, 1999 — Today the Szabolcs-Szatmar-Bereg
County Court brought its second instance decision regarding the school
discrimination against Romani children in the East-Hungarian town of
Tiszavasvari. 

The court approved the first instance decision of the Nymregyhaza
Town  Court, which found the practice of segregated graduation
ceremonies in the Pethe Ferenc Elementary School illegal. The Romani
children were also banned from using the school's gym. The court ruled
that the school's superior authority, the local government must pay a
compensation of HUF 100.000 (Apr. 450 USD) per children. As earlier
reported by the Roma Press Center, the Romani children in the school
were placed in segregated classes, had no access to the gym and the
cafeteria, and above all were organized a segregated graduation
ceremony in 1997. The Romani Civil Rights Foundation, which provided
legal representation for 14 children, filed a lawsuit against the
school, requesting material compensation, and to end the school's
discriminatory and the segregatory practices. The court ruled that the
children's human Rights were violated, and also found the charges of
discrimination substantial. Aladar Horvath, president of the Romani
Civil Rights Foundation called today's decision a milestone in the
Hungarian legal practice related to school discrimination. Horvath
expressed his thanks to the children and their parents for their
courage and persistence. However, Romani children currently enrolled
in the Pethe Ferenc school still complain about lacking access to the
gym and the continued existence of "Gypsy" classes.
