EDUCATION

Education is a state supported priority sphere in the development of the Republic of Lithuania. It is based on the humanistic cultural values of the nation and the world, on the principles of democracy and the universally recognised human rights and freedoms. Education determines the cultural, social and economic progress of the country, consolidates solidarity, tolerance and co-operation among people and nations.

This Law shall establish the foundations governing the structure, activities and management of educational institutions (with the exception of the institutions of higher education) of the Republic of Lithuania.

I. General Provisions

Article 1. Goals of the Educational System

The major goals of the educational system shall be:

1) to develop the mental and physical abilities of an individual, to lay solid foundations of morality and a healthy way of life, to cultivate his/her intellect, providing conditions for the further development of the individual;

2) to offer children both general and professional education in conformity with the current level of science and culture;

3) to provide possibilities of a continuing education for the residents of Lithuania;

4) to foster civic awareness, the understanding of individual rights and duties to the family, the nation, society and the State of Lithuania, as well as the need to participate in the cultural, social, economic and political life of the Republic.

Article 2. The Educational System of Lithuania

The educational system of Lithuania shall comprise pre-school education, general education of children and young people, vocational and tertiary education, higher education, and education of the adults provided at the educational institutions of the following type:

institutions of pre-school education;
schools of general education;
vocational schools;
tertiary schools;
institutions of higher education;
institutions of additional and informal education.

Article 3. Pre-school Development

Children under 6 (7), upon the request of their parents (guardians, foster parents) shall be brought up in nursery schools and infants� classes of primary schools. Orphans and neglected children shall be brought up in child care institutions.

The state shall encourage the upbringing of children under 6 (7) at home, and shall provide compensatory allowances. Families bringing up children at home shall be provided methodological, diagnostic advice and counselling by educational and health care institutions.

Article 4. General Secondary Education

General secondary education shall be acquired in the three-stage general school over a period of twelve years. The stages of schooling may form separate administrative units: primary, basic and secondary schools. The duration of the course of study at such schools shall be established by the regulations of the secondary school of general education.

General education may be also acquired together with the basic work skills at young people�s schools.

A grammar school is a separate type of a secondary school.

General secondary education may also be provided by a vocational school of an appropriate level.

Adults may obtain education at secondary schools for adults (learning centres), adult divisions (classes) of general schools.

Children undergoing treatment in sanatoria may get education at the sanatoria general secondary schools. Children undergoing treatment in hospitals or at home shall be educated, subject to their doctor�s permission, in accordance with the procedures established by the Ministry of Education and Science.

Schools of general education and vocational schools of a disciplinary type shall be established for schoolchildren exhibiting antisocial behaviour.

Article 5. Vocational Training

Vocational education and higher vocational qualifications shall be provided at institutions of vocational training (vocational schools, colleges, adult training centres and other educational establishments). Vocational training shall be co-ordinated with general education.

Vocational schools shall admit students with basic or general secondary education. Education at those schools shall be provided according to a single-level or multi-level programmes. Students without basic education but not younger than 15 years of age may also be enrolled in accordance with the procedure prescribed by the Ministry of Education and Science.

Article 6. Tertiary (College-Level) Education

Specialists with tertiary education shall be trained at the institutions of tertiary education (colleges, conservatoires, etc.). Persons eligible for enrolment in such institutions must have completed secondary education.

The course of studies at those institutions shall last from two to four years.

Institutions of tertiary education may have departments of general education and vocational education.

Institutions of tertiary education may train students for a BA degree which shall be awarded by university-level institutions.

Article 61. Higher (University-level) Education

Higher education shall be provided by higher educational (university-level) institutions.

The manner of establishing, reorganising, closing down of higher educational institutions, organisation of studies, the principles of activities and management of the institutions shall be regulated by the Law of the Republic of Lithuania on Science and Studies and the statutes of the higher educational institutions.

Higher educational institutions not maintained by the state shall be established, reorganised and closed down by legal and natural persons of the Republic of Lithuania subject to a licence obtained from the Government of the Republic of Lithuania. Educational institutions without such a licence shall be prohibited from announcing admission of students and from organising studies.

Article 7. Supplementary Training

Those who wish shall be provided additional training at various types of educational establishments: art, sports, language, engineering and other schools, courses and societies.

Article 8. Educational Qualifications

The following degrees of educational qualifications shall be established in the Republic of Lithuania: primary education, basic education, secondary education, tertiary education, and higher education.

Article 9. Establishment, Reorganisation and Closing down of Educational Institutions

Educational institutions maintained by the State and the local government shall be established, reorganised and closed down by the Ministry of Education and Science of the Republic of Lithuania, county governors and municipal councils subject to a written consent of the Ministry of Education and Science of the Republic of Lithuania.

Public educational institutions may be established, reorganised and closed down by other ministries and agencies of the Government of the Republic of Lithuania subject to a written consent of the Ministry of Education and Science.

Educational institutions not maintained by the State shall be established, reorganised, and closed down, subject to the consent of the Ministry of Education and Science by legal persons registered in the Republic of Lithuania or by individual citizens of Lithuania. Legal and natural persons of other countries may establish educational institutions or be founders of joint educational institutions subject to a permission of the college of the Ministry of Education and Science.

Public educational institutions may establish joint educational institutions with foreign countries subject to the consent of the founder and a permission of the Ministry of Education and Science.

If the activities of an educational institution which is not maintained by the State are in violation of the laws of the Republic of Lithuania, the Ministry of Education and Science may, at its own initiative, suspend the activities of such an institution pending the settlement of the dispute in court.

Educational institutions shall have the status of a legal person and shall be under the control of the founders. Educational institutions shall be registered in the manner prescribed by the Government of the Republic of Lithuania.

The procedure of establishment, reorganisation and closing down of educational institutions shall be in accordance with the regulations which shall be approved by the Government of the Republic of Lithuania.

Article 10. The Language of Instruction

The language of instruction at Lithuanian schools of the Republic of Lithuania shall be Lithuanian.

Populous and compact communities of ethnic minorities in the Republic of Lithuania shall be provided facilities for having public or maintained pre-school institutions, schools of general education and lessons in the mother tongue. Parents (guardians, foster parents) shall choose for the children a pre-school institution or a school of general education with instruction in an appropriate language.

For small and non-compact ethnic communities, classes or optional courses as well as Sunday schools may be set up at public schools of general education for the purpose of learning or acquiring a better knowledge of the mother tongue.

In non-Lithuanian educational institutions, Lithuanian language and literature shall be taught in Lithuanian. If the parents or children so desire, facilities shall be provided for studying other subjects in the Lithuanian language as well.

All secondary schools of general education must ensure a command of the Lithuanian language in accordance with the standards established by the Ministry of Education and Science.

Facilities shall be provided throughout the territory of the Republic of Lithuania to have instruction in the Lithuanian language.

Article 11. Health Care

In all educational institutions facilities intended to help pupils and students to protect their health and stay healthy shall be provided. Ministries and other agencies of the Government of the Republic of Lithuania, county governors, the local government institutions, organisations, and citizens in charge of educational institutions shall ensure that adequate conditions for studying, nutrition, physical education and sports, medical and psychological aid shall be provided at these schools, in accordance with the requirements set forth in statutory acts.

Article 12. Development and Education of Mentally or Physically Disabled Children and Schoolchildren

All mentally or physically disabled schoolchildren shall be educated either at home, in general or corrective groups in pre-school educational institutions, special pre-school institutions, in general or corrective classes of general secondary schools, and special schools situated as close as possible to their home.

Children shall be referred for corrective or special education by commissions of diagnostic specialists on the basis of character of the disability, the degree of its severity and complexity. If the parents disagree with the decision of the commission of diagnostic specialists, their appeal shall be considered by the national commission of diagnostic specialists.

Referring for corrective or special treatment, as well as provision, supervision and control of corrective aid shall be carried out in accordance with the procedures established by the Ministry of Education and Science and the Ministry of Health.

Article 13. Tuition Fee

Instruction at public schools of general education, vocational schools, and colleges of the Republic of Lithuania shall be free. Instruction at public pre- school institutions (with the exception of child care institutions) as well as at institutions of additional education which are maintained or supported by the state, shall be paid in part.

Tuition at private educational institutions shall be payable subject to an agreement.

Article 14. Financial Assistance for Pupils and Students

The state shall grant allowances for pupils and students in need of financial assistance and shall allocate funds for grants and credits.

Article 15. Remuneration for Teachers

Teachers of public educational institutions shall be paid remuneration according to the length of service, education, qualifications and workload.

At public educational institutions, teachers shall be paid for additional out-of class work.

Teachers working at educational institutions located in rural areas, as well as in areas and spheres of education the development whereof requires a special assistance of the state, shall be given financial incentives. Those teachers shall be granted privileges in the a manner prescribed by the Government.

Article 151. Teacher Training

Teachers for the educational system of Lithuania shall be trained by higher and tertiary educational institutions in the manner prescribed by the Government of the Republic of Lithuania.

The number of teachers to be trained at higher educational institutions shall be established, taking into account the needs of the state, by the Government of the Republic of Lithuania on the recommendation of the Ministry of Education and Science.

The number of teachers trained at teacher training colleges and their specialisation shall be established by the Ministry of Education and Science.

Article 16. Children and Youth Organisations

Educational institutions of Lithuania may have children and youth organisations designed to foster moral, civic, cultural, physical and social maturity of pupils, and help to meet their needs in self-education and self-expression. The activities of such organisations shall be based on the statutes registered in accordance with the prescribed manner, and they shall not contradict either the Constitution of the Republic of Lithuania or any other laws. Children and youth organisations functioning at educational establishments shall be provided favourable conditions for the pursuit of their activities.

Article 17. Religious Instruction at Public Educational Institutions

At the request of the parents (guardians, foster parents), individuals authorised by church dignitaries shall give religious instruction (of the requested denominations) at public educational institutions.

Children under state care shall be given religious instruction conforming to the religion that had been professed by their family or relatives.

For those who do not attend classes of religious instruction, that time shall be given over to the teaching of subjects related to moral or civic education.

II. Rights, Duties and Responsibilities of Pupils, Parents and Teachers

Article 18. Pupils� Rights

Pupils shall have the right:

1) to enrol in any educational institution of their choice provided their education and other requirements (health, command of the language of instruction) are in conformity with the terms of admission;

2) from the age of 15 to take an independent decision on whether they are going to take religious instruction;

3) to join children and youth organisations, to promote their activities, and to take part in educational and arts societies;

4) to participate in the self-governance of the educational institution in the manner established by the regulations of the institution;

5) to take externally any yearly (course) examinations of a secondary or vocational school or the final school examinations.

Article 19. Pupils� Duties

Pupils must:

1) get general education or attend a general secondary school or a school of a different type until the age of 16;

2) observe the rules of the educational institution, regularly attend school.

Article 20. Rights of Parents (Guardians, Foster Parents)

Parents (guardians, foster parents) shall have the right to:

1) freely choose between a public or non-public educational institution for their children;

2) send their children to the school assigned according to the parents� place of residence or another pre-school or school of general education of their choice;

3) participate in the self-governance of educational institutions;

4) obtain from the educational institution the information concerning their children�s progress, conduct, also the conditions of study.

Article 21. Duties of Parents (Guardians, Foster Parents)

Parents (guardians, foster parents) must:

1) provide conditions for life and study for their children guaranteeing a sound and secure development of their mental and physical abilities as well as their moral improvement, be responsible for the education and development of their children;

2) send their children from the age of 6 (7) to schools of general education if they have achieved an adequate level of physical and mental development. Upon submitting documents confirming the adequate level of the child�s mental-physical development, parents may send to school a child who has not reached the age of 6 on the day of start of the school year or may not send to school a child who has already reached the age of 7;

3) co-operate with educational institutions in solving the questions concerning education of children and pupils, ensure that children get general education or attend a general secondary school or a school of a different type until the age of 16.

Article 22. The Right to Work in the Teaching Profession

Persons who have higher or tertiary pedagogical education, also persons with non-pedagogical higher or tertiary education and having teaching qualifications established by the state shall have the right to work in the teaching profession at an educational institution of an appropriate level.

Persons who have only vocational education shall also have the right to teach a vocational course at vocational educational institutions. Those persons must get teaching qualifications in the manner prescribed by the Ministry of Education and Science.

Article 221. Certification of the Teachers

Teachers, heads, inspectors of educational institutions, shall be provided conditions to undergo certification. The manner of certification and qualifications categories shall be set forth in the regulations approved by the Ministry of Education and Science.

Certification shall be compulsory at least every five years.

Heads and inspectors of educational institutions who fail during five years of work to have the lowest qualifications category approved shall lose the right to hold their post. Teachers who during five years fail to have the qualifications category of a teacher (pedagogue) approved shall lose the right to work in the teaching profession.

Article 23. Teachers� Rights

A teacher has the right to:

1) freely chose the manner and forms of organising the teaching activities;

2) improve his/her qualifications and receive an appropriate remuneration;

3) adequate work conditions;

4) annual extended holidays;

5) take part in the self-governance of public educational institutions;

6) join trade unions and other public organisations;

7) get a paid leave of up to one year for writing textbooks.

Article 24. Teachers� Duties

Teachers must:

1) foster firm moral standards of their students, and guarantee a safe and sound development of their personality;

2) ensure that the pupils fully master the curricula;

3) adhere to the principles of pedagogical ethics;

4) participate in extracurricular activities which help to meet the pupils� needs for self-expression and self-education and further develop their cultural interests of the pupils;

5) improve their qualifications;

6) co-operate with parents ( guardians, foster parents) in taking decisions related to children�s teaching and education.

Article 25. The Responsibility of Pupils, Parents( Guardians, Foster Parents) and Teachers

Pupils who do not perform their duties shall be disciplined in accordance with the manner set forth in the regulations of the educational institution.

Parents (guardians, foster parents) and teachers who do not perform their duties, who cause physical, psychological, or moral harm to their pupils, shall be accountable in accordance with the procedures established by law.

III. The Organisation and Management of the Educational Process

Article 26. The Organisation of the Educational Process

Educational institutions of the Republic of Lithuania shall function according to the syllabus and national curricula approved or co-ordinated in the prescribed manner by the Ministry of Education and Science. The contents and methods of teaching must be in accordance with the tasks of the educational institution and the needs of society. The contents of teaching of separate types and levels of schools shall be co-ordinated among the schools.

It shall be prohibited to propagate racial, national, religious, social hatred and superiority, to spread militaristic and other ideas which are against the universally accepted principles of international law and humanism.

The curricula of educational institutions of ethnic minorities may be supplemented by the elements of ethnic culture.

At secondary schools of general education, in addition to Lithuanian, other languages shall be taught depending on the preference of the parents and the facilities available at the school.

Article 27. The Beginning of the School Year

The school year at the educational institutions shall begin on the 1st of September.

Article 28. Regulations of the Activities of Educational Institutions

The activities of public educational institutions shall be governed by the regulations of the institution approved by the local authorities and endorsed by the founder. The regulations must not be in contravention of this Law and other laws of the Republic of Lithuania or the uniform regulations of the activities of educational institutions of the appropriate type.

The regulations of non-public educational institutions shall be co-ordinated in the manner prescribed by the Ministry of Education and Science.

Article 29. Certification of Graduation from Educational Institutions

Individuals who have graduated from an educational institution or a separate level of such an institution shall be issued a document, as established by the Ministry of Education and Science, which will certify education they received. Individuals who have graduated from non-public educational institutions shall be issued an analogous certificate if the education provided by these institutions is in accordance with the state standards. Graduation documents (school leaving certificates, diplomas) shall be issued in the manner established by the Ministry of Education and Science.

Article 30. Supervision of Education at Educational Institutions

The quality of education at all educational institutions shall be supervised by a uniform state inspectorate of education comprising inspectors of the Ministry of Education and Science and of the county governors� administration functioning in accordance with the regulations approved by the Ministry of Education and Science. The state inspectorate of education shall periodically report to the public, in the manner established by the Ministry of Education and Science, about the state of education in Lithuania and its separate regions, the quality of education provided by the educational institutions.

Only persons specified in the respective regulations of the certification commissions, the state inspectorates of education, and of an educational institution shall have the right to observe the work of a teacher. Other persons may observe a teacher�s work only subject to the teacher�s consent.

Article 31. The Powers of the Ministry of Education and Science in the Sphere of Education

The Ministry of Education and Science:

1) shall establish, reorganise and close down educational institutions which are subordinate to it, shall appoint and dismiss heads of such institutions, together with the Ministry of the Interior and the Ministry of Social Security and Labour and other Government institutions shall ensure that all children under 16, who have not finished the basic school, attend a school of general education or some other type of school;

2) shall approve the establishment and reorganisation of both public educational institutions which are not under its control and non-public educational institutions, with the exception of pre-school educational institutions, primary schools of general education, and institutions of additional education and adult informal education;

3) may suspend the activities of non-public educational institutions if they contradict the laws;

4) shall approve the uniform regulations of public educational institutions or educational institutions subordinate to it;

5) shall submit its conclusions concerning the registration of regulations of children and youth organisations to the Ministry of Justice;

6) shall approve the uniform contents of teaching ( curricula, uniform syllabi, text-books) for national and municipal public educational institutions;

7) shall organise the preparation, production and publication of curricula, syllabi, textbooks, educational aids and literature;

8) shall establish the state standards of the various levels of education (with the exception of higher education and post graduate doctoral studies);

9) shall approve, in writing, the establishment, reorganisation and closure of educational departments at the county governors� administration, the appointment and dismissal of the heads of those departments, also the establishment, reorganisation and closure of educational institutions under the control of county governors or the local government, with the exception of pre-school educational institutions, elementary schools, the institutions of additional education, as well as adult institutions of informal education, the appointment and dismissal of their heads. Heads of educational institutions may be dismissed on the initiative of the Ministry, county governors or municipalities with the approval of the Ministry of Education and Science;

10) shall be concerned with the training of teachers and the improvement of their qualifications, and shall organise a systematic certification of teachers, heads of educational institutions and inspectors of the State School Inspectorate;

11) shall approve, from the point of view of pedagogical functionalism, the architectural design of projected educational institutions commissioned by it;

12) shall recognise graduation documents (certificates, diplomas) of secondary, vocational and tertiary education obtained abroad;

13) shall establish the general principles of financing of educational institutions;

14) shall finance state syllabi;

15) shall establish teachers� educational standards;

16) shall set forth and submit to the Government of the Republic of Lithuania proposals regarding how many and in what fields the institutions of higher education should train teachers;

17) shall co-ordinate and approve together with higher educational institutions the curricula for degrees of Bachelor of Education and Master of Education;

18) shall organise the final examinations in principal subjects of general secondary education, shall form the commissions for developing examination tasks, for supervising the examinations and for marking the examination papers;

19) shall organise registration of specialisation of educational institutions and of tertiary and vocational institutions in the manner prescribed by the Government of the Republic of Lithuania;

20) shall supervise and co-ordinate the activities of the administration of county governors and the administration of the local government;

Article 32. The Competence of Other Ministries and Departments in the Field of Education

Other ministries and departments of the Republic of Lithuania:

1) upon agreement with the Ministry of Education and Science, shall establish, reorganise, and close down educational institutions under their control, and shall appoint and dismiss their heads;

2) upon agreement with the Ministry of Education and Science, shall approve the uniform regulations of the activities of educational institutions under their regulation or under their control;

3) shall approve curricula, syllabi and text-books of educational institutions under their control, and shall organise their development and publishing;

4) shall co-ordinate with the Ministry of Education and Science the curricula and syllabi of general educational subjects of educational institutions under their control;

5) shall take part in establishing the standards of education provided by vocational schools and tertiary schools under their control;

6) shall be concerned with the training of teachers of special subjects, the improvement of their qualifications, and shall organise their systematic certification.

Article 33. The Competence of County Governor in the Field of Education

The county governor:

1) shall, upon a written consent of the Ministry of Education and Science, establish, reorganise, and close down educational departments of the administration of the county governor, appoint and dismiss their heads;

2) shall, upon a written consent of the Ministry of Education and Science, establish, reorganise and close down county public educational institutions with the exception of institutions of higher education;

3) shall give an approval in writing to the establishment, reorganisation and closure of educational institutions in the territory of the county;

4) shall, upon a written approval of the Ministry of Education and Science, appoint and dismiss heads of the educational institutions under its control;

5) shall give an approval in writing of the appointment and dismissal of heads of public educational institutions under the control of the local government on the territory of the county;

6) shall ensure the functioning and maintenance of public educational institutions under its control;

7) shall approve the regulations of the public educational institutions under its control;

8) shall supervise the implementation of general educational policy in the county, inspect the public and non-public educational institutions in the territory of the county;

9) shall supervise the handling of registration of the school-age children by the local government and secure that all the children under 16 years of age living in the territory of the county who have not finished the basic school attend schools of general education or other schools, shall take care of the protection of children�s rights;

10) shall provide facilities for heads and teachers of county public educational institutions to improve their qualifications, shall organise their certification in the manner prescribed by the Ministry of Education and Science;

11) shall register educational institutions in the manner prescribed by the Government of the Republic of Lithuania;

12) shall initiate the establishment of the county council of education and other institutions of the local government;

13) shall report, in the prescribed manner, about the state and problems of education in the county to the Ministry of Education and Science.

Article 331 The Competence of the Local Government in the Field of Education

The local government:

1) shall, upon the consent of the county governor, establish, reorganise and close down pre-school educational institutions, primary schools of general education, educational institutions of additional education and adult informal educational institutions, appoint and dismiss their heads;

2) shall, upon a written consent of the Ministry of Education and Science and of the county governor, establish, reorganise and close down the basic and secondary schools of general education of all types, appoint and dismiss heads of those educational institutions;

3) shall, in the manner established by the Government of the Republic of Lithuania, approve the establishment, reorganisation and closure of the non-public educational institutions in the territory of counties listed in subparagraphs 1 and 2 of this Article;

4) shall approve the regulations of the educational institutions under their control;

5) shall ensure the implementation of the laws, decisions of the Government of the Republic of Lithuania, acts of the Ministry of Education and Science and of other institutions at the educational establishment under its control;

6) shall ensure the functioning and maintenance of the educational establishments under its control;

7) shall manage an accurate registration of children of school age, compile their lists and ensure that all the children under 16 living in the territory of the county who have not completed the course of the basic school, attend the school of general education or some other type of school, and shall take care of the protection of children�s rights;

8) shall organise free transport to and from school for pupils of rural schools of general education living at a greater distance from the school;

9) shall provide facilities for heads and teachers of educational institutions under its control to improve their qualifications, and shall organise their certification in the manner prescribed by the Ministry of Education and Science;

10) shall provide, in the prescribed manner, information to the public, the county governor and the Ministry of Education and Science about the condition of education and its problems.

Article 34. The Lithuanian Council for Education

The Lithuanian Council for Education is an institution performing the functions of an expert and consultant in adopting decisions on the strategic issues of the development of education in Lithuania.

The Council shall be formed and shall function in accordance with the regulations approved by the Government of the Republic of Lithuania.

Article 35. Self-Governance of State Educational Institutions

Every public educational institutions must have institutions of self-governance - the school council and the teachers� council; other self-governance institutions may also function.

Self-governance institutions:

1) shall approve the regulations of the educational institution;

2) shall develop long-term plans for the financial-economic activities of the educational institution; and

3) shall supervise the financial-economic activities of the educational institution.

Within their competence, the bodies of self-governance shall have the right to get information from the administration about the activities of the educational institution.

The competence of the bodies of self-governance of public educational institutions shall be defined in the uniform regulations of the activities of educational institutions of an appropriate type (level).

Article 36. The Financing of Educational Institutions

The main sources of financing public educational institutions are the budgets of the local government and the budget of the Republic of Lithuania. State financing shall guarantee normal conditions for the functioning of these institutions. Other sources of financing are the Lithuanian Fund for Education, funds for education of towns and regions, and non-budgetary funds of educational institutions.

When establishing joint educational institutions with foreign countries, the amount of foreign capital shall not be limited.

Private educational institutions shall be maintained by their founders. For study programs of non-public educational institutions providing education in accordance with the state standards, allocations from the budget shall be made in the manner established by the Government of the Republic of Lithuania as to public educational institutions of the corresponding type. The amount of funds shall be established with account of the expenditure set for one child, pupil of a public educational institutions of the corresponding type.

For private institutions which guarantee education in accordance with the state standard allocations may be made in the manner established by the Government.

Article 37. Education Funds

The sources of formation of the Lithuanian Fund for Education and County and Municipal Funds for Education are:

1) voluntary donations of individuals, organisations and enterprises;

2) income from the activities of the Fund;

3) funds and material values donated by organisations and citizens of foreign states, as well as by international organisations.

The regulations of the Lithuanian Fund for Education, as well as framework regulations of town (region) funds for education shall be approved by the Government of the Republic of Lithuania.

IV. International Relations

Article 38. The Right of Lithuanian Citizens to Study Abroad and Lithuanian Educational Institutions in Foreign Countries

Residents of Lithuania shall have the right to study in foreign countries. This right shall be exercised on the initiative of an individual or through interstate agreements.

Lithuanian educational institutions in foreign countries shall be organised and financial/material assistance shall be provided to them in the manner provided by interstate agreements.

Article 39. Teaching Activities and Studying of Foreign Citizens and Persons without Citizenship in the Republic of Lithuania

Foreign citizens or persons without citizenship shall have the right to teach and study in the Republic of Lithuania. Conditions for their work and study at the educational institutions of Lithuania shall be provided by appropriate legal acts of the Republic of Lithuania and international agreements.

Article 40. International Agreements

If an international agreement to which the Republic of Lithuania is a party prescribes rules other than those provided by this Law, the provisions of the international agreement shall be applicable.
