LAW ON EDUCATION IN LANGUAGES AND LETTERS OF NATIONAL MINORITIES

FINAL PREPOSITION

Article 1.
National minorities in the Republic of Croatia fulfill right to education in their language and letter (hereafter: education in language and letter of national minority) according to
Constitution and closures of this law.
This law has no effect on rights about education of national minorities acquired by earlier regulations and on basis of international agreements signed by the Republic of Croatia.

Article 2.
Education in language and letter of national minority is held in preschool facilities, primary and secondary schools, or other school facilities (hereafter: school facility with tuition in language and letter of national minority) as well as in other forms of education (seminars, summer and winter school, etc.) in ways and terms of this law.
On founding, legal position and governing of school facility with tuition in language and letter of national minority, the clauses of other laws and regulations are to be applied, unless differently set by this law.

Article 3.
School facility that holds tuition in language and letter of national minority can be formed for a lesser number of pupils then set for a school facility with tuition in Croatian language and letter.

Article 4.
If there are no conditions for forming a school facility according to article 3. of this law education in language and letter of national minority is to be held in a class section or educational group.
Class section and educational group from paragraph 1. are formed in a school facility that holds tuition in language and letter of national minority or a school facility that holds tuition in Croatian language and letter.
Class section and educational group from paragraph 1. can be formed for a lesser number of pupils then set for a class section and educational group that holds tuition in Croatian Language and letter.

Article 5.
Denomination of school facility that holds tuition in language and letter of national minority and seal and stamp inscriptions are to be written in Croatian language and Latin script as well as in the language and letter of national minority.

Article 6.
Educational plan and program for national minorities consists of a general part following contents closely related to the national minority (language, literature, history, geography & culture of national minority).
A part of educational plan and program from paragraph 1. of this article whose contents are closely related to national minority are defined and approved by Ministry of education and sports considering opinions of national minority societies.

Article 7.
Enrolment in school facility, class section or educational group in language and letter of national minority is held under the same terms as enrolment in school facility teaching in Croatian language and letter, according to the prior decision on enrolment.
If more pupils apply for enrolment in school facility, class section or educational group than regulated by the terms of enrolment, pupils belonging to national minority will have advantage to enroll over other pupils.

Article 8.
Pupils of school facility, class section or educational group that holds tuition in language and letter of national minority are obligated to study Croatian language and Latin script according to the educational plan and program.

Article 9.
In the area where equal usage of both languages is defined by city or district regulations, pupils of school facility teaching in Croatian language and letter will be given the opportunity to learn language and letter of national minority.

Article 10.
In school facility teaching in language and letter of national minority tuition is held by teachers belonging to national minority concerned or to whom the language of national minority is mother language or who are fully proficient in language and letter of national minority.

Article 11.
School documents and registers of school facility teaching in language and letter of national minority are held on both: Croatian language and Latin script and language and letter of national minority.
Official school papers and certificates of school facility teaching in language and letter of national minority from paragraph 1 of this Article are published on both: Croatian language and Latin script and language and letter of national minority, according to the Low.

Article 12.
Majority of members in the governing body of school facility teaching in language and letter of national minority has to belong to national minority concerned.
Details on compound, terms and ways of election of the governing body members are set by regulations of facility concerned.
Only a person belonging to national minority or is proficient in language and letter of national minority can be chosen for the headmaster of the school facility mentioned in paragraph 1. of this article.

Article 13.
Ministry of Education and Sports are obligated to ensure sufficient number of advisers and supervisors belonging to national minority concerned or are proficient in language and letter of national minority.

Article 14.
Higher educational institutes according to the law provide professional training of teachers needed for school facilities teaching in language and letter of national minority or they are given opportunity to master the language and letter skills otherwise.

Article 15.
For publishing textbooks on language and letter of national minority general regulations on publishing are applied.
School facilities teaching in language and letter of national minority may use textbooks from mother countries with approval of Ministry of Education and Sports.

Article 16.
Funds needed for regular operations of public school facility, class section and educational group teaching in language and letter of national minority are provided by the state.
School facility teaching in language and letter of national minority may be funded from other sources, according to the law.

Article 17.
Ministry of Education and Sports will introduce educational plan and program from article 6. of this law within six months from the day that this law is validated.

Article 18.
Minister of Education and Sports may introduce terms of usage of regulations in this law in school facilities teaching in language and letter of national minority.

Article 19.
School facilities teaching language and letter of national minority will match their general regulations with the regulations of this law at the latest within three months from the day that article 17. of this law is validated.

Article 20.
With legalisation of this law, the Law on education in minority languages (�Narodne Novine�, no. 25/79) is considered invalid.

Article 21.
This Law is to become valid on the eighth day from its publication in �Narodne Novine�.
