On the basis of the Article 89. Of the Constitution of republic of Croatia, I announce

DECISION
ON PROCLAMATION OF LAW ON CORRECTIONS AND AMENDMENTS OF THE LAW ON ELECTION OF MEMBERS OF REPRESENTATIVE BODIES OF LOCAL SELF-ADMINISTRATION AND ADMINISTRATION

I proclaim Law on corrections and amendments of the Law on election of members of representative bodies of local self-administration and administration, which was brought by Chamber of Deputies of Croatian National Sabor on its session of 28 June 1996.

ON CORRECTIONS AND AMENDMENTS OF THE LAW ON ELECTION OF MEMBERS OF REPRESENTATIVE BODIES OF LOCAL SELF-ADMINISTRATION AND ADMINISTRATION

Article 9.
Article 10. has been changed and sounds:

“Croatian citizens members of ethnic and national communities or minorities who consist at least 8% of electoral body of the particular local self-administrative unit, i.e. unit of local administration and self-administration, shall have a right to equivalent representation (to their percentage) in representative body of the same unit of local administration, i.e. local administration and self-administration.

Members of ethnic and national communities and minorities who consist less than 8% of electoral body on the state level, shall have a right for representation in representative body of local self-administrative unit, i.e. unit of local administration and self-administration in accordance to the prescription provided in a Charter of those same units of local administration, i.e. unit of local administration and self-administration.”

Article 20.
Article 28. changes and sounds:

“If the representation of ethnic and national communities or minorities will not be achieved in accordance to the provisions of this Law, a number of members of representative body of unit of local self-administration, i.e. unit of local administration and self-administration shall be increased up to number which is needed for its realization; elected will be considered members of particular minority who were candidates but not elected on election lists for members of representative bodies of units of local self-administration, i.e. unit of local administration and self-administration. They will be selected in accordance to the success of each list participating in elections.”

TRANSITIONAL AND FINAL REGULATIONS

Article 38.

Representative bodies of local self-administrative units, i.e. units of local administration and self-administration which did not regulated by Charter a number of members in their representative bodies, as well as representative bodies of newly formed units of local self-administration, i.e. units of local administration and self-administration shall elect their members in following order:
- cities and municipalities up to 10.000 inhabitants, 20 members,
- cities and municipalities do 20.000 inhabitants, 25 members,
- cities up to 40.000 inhabitants, 30 members,
- cities up to 100.000 inhabitants, 40 members,
- cities with more than 100.000 inhabitants, 45 members,
- counties, 45 members.

Article 44.

The implementation of this Law begins on the eight day of its publication in "Narodne novine”.
